1. Who provides the service

The Boa Porta, available at Boaporta.pt, is operated by Vortica Digital, Lda., NIPC 514465670, with a professional address in the Rua D. João V, 24, Leap Center, 1290-091 Lisbon, Portugal. 2. The paper and limits of the Boa Porta

Boa Porta provides tools for creating and sharing profiles and presenting opinions on lease experiences. User content is provided by the respective authors: they do not constitute Boa Porta statements, recommendations or guarantees.

Boa Porta is not a party to rental agreements, real estate agent, guarantor, insurance company, credit information agency or general person certification entity. Does not choose landlords or tenants, does not charge rents or guarantees, does not guarantee payments, does not resolve leasing disputes and does not provide personalized legal advice.

Users can create accounts and profiles, publish comments and manage the comments they have written. Comments with email are public after confirmation of this address. Comments without email do not have this confirmation. The “Validated Account” indication confirms only the access to the email, not the leasing identity or experience.

3. Account, age and acceptance

Account creation requires an age of 18 or over, ability to accept these terms, indication of true data and control of the email address provided. A person can present himself as a landlord and tenant on the same account.

The user must protect his or her credentials, do not give the account, not impersonate another person and report suspects of improper access. The confirmation of the email proves access to this address; It does not prove civil identity, property of real estate, solvency or suitability.

When creating an account, the user accepts the version of the terms presented in the form. Information on data processing is privacy policy; Contractual acceptance is not a generic consent for advertising or for any data processing.

4. Publication and profile visibility

Profiles are private by default. The publication depends on confirmation of the email and an express action by the holder. An active profile can be consulted and searched by anyone, including visitors without an account. The holder is responsible for the information he decides to make public and for the legitimacy to use it.

Deactivation removes the profile from search and prevents public access on Boa Porta, including the permanent link and QR. It does not delete the account or the private history. It does not allow to delete copies, screenshots or shares previously made by third parties outside of our control. Sharing a link or QR does not change these rules. The QR just forwards to an address; does not constitute a certificate.

5. Responsibility of those who provide content

Each author is responsible for the authorship, accuracy of the facts that he affirms, lawfulness and updating of the contents he provides, as well as for the image rights, privacy and intellectual property involved. It must have the legitimacy to identify an experience and distinguish directly experienced facts, personal opinions and third-party information.

It is forbidden to publish deliberately false information, manufacture experiences, manipulate references, create accounts to influence assessments, pay or offer advantages for misleading opinions, or coerce someone to participate. An unfavorable opinion is not prohibited just because it is unfavorable; It must respect the law, be pertinent and not present unfounded charges as demonstrated facts.

Insults, threats, persecution, discrimination, exposure of complete addresses, identification documents, NIF, bank details, private contacts of third parties, health data, intimate life or other unnecessary information are also prohibited; dissemination of data from minors; illicit content; spam; fraud; service attacks; Massive extraction of profiles; and use of the portal as a blacklist or instrument of discrimination.

Do not send personal documents or complete contracts by email without the team requesting them through an appropriate procedure. When it is necessary to substantiate a complaint, provide only the indispensable elements and hide data from third parties that are not relevant.

The author does not transfer ownership of its content to Boa Porta. It only grants the non-exclusive and free authorization necessary to lodge it, present it according to the chosen visibility, technically adapt to the service and treat complaints. This authorization does not allow you to sell the content or reuse it in third-party advertising. Conservations required by law or necessary for the defense of rights follow the privacy policy.

6. Responsibility of those who consult

The reader must confirm that he has found the right person, assess the context, timeliness and limitations of the information and make the appropriate independent checks before deciding. A reference translates the author's perspective and can be incomplete, contested or incorrect. The absence of references, the refusal of an invitation and the deactivation of a profile do not demonstrate negative behavior.

Do not use a profile or stamp as the sole grounds for entering into or refusing a contract, handing over money, sharing documents or making decisions with an impact on another person. The choices and contracts entered into by users are your responsibility. The portal does not guarantee the success, security or the result of any relationship between people.

7. Email confirmation and verification limits

The “Validated Account” indication means that access to the e-mail address associated with the author has been confirmed. It does not certify civil identity, ownership, fulfillment of contracts, solvency or the authenticity of a lease experience. There is no document verification of contracts or assignment of lease stamps.

The same email cannot post repeated comments on the same profile. There are technical measures to reduce abuse and repetitions, with no guarantee of detection of all improper uses. The author can manage his comments in the private area.

8. Complaints of content and contestation

You can report content or profile through Email@boaporta.pt, with the subject «Complaint Boa Porta». People without an account can also use this channel. Indicate the exact URL or profile code, the content in question, the concrete reasons for the alleged illegality or violation of these Terms, the strictly necessary support elements, your name and contact email, and a statement of good faith that the information presented is accurate and complete according to your knowledge. The legally envisaged exceptions of identification apply.

It is not necessary to obtain a sentence to report a problem. An incomplete request may require clarification. The team acknowledges receipt, assesses the report in a diligent, objective and proportional way and communicates the decision and the applicable means of contestation. The identity of the complainant is not made public by rule, without prejudice to legal obligations and of the strictly necessary for the defense of rights.

We may limit visibility, block content or suspend an account while we assess the risks, and remove unlawful or incompatible content with these Terms. The action is not a judicial decision on who is right in the lease. When legally applicable, the affected person receives reasoning and information about the means of reaction. You can ask for reassessment for the same contact, identifying the decision and reasons for disagreement; The request is reviewed by a person and, whenever possible, by someone other than the one who decided initially. There is no cost to file complaints or requests for reconsideration. the administrative and judicial means available are maintained.

Boa Porta does not guarantee prior detection of all falsehoods or performs a general surveillance of all contents. This does not rule out the duties of diligent action after knowledge of illicit content or the fulfillment of orders from the authorities. Abusive and repeated complaints or repeatedly illegal publications may justify proportional restrictions, preceded by a warning when appropriate.

9. Operator Limits of Liability

The responsibility for the content provided by users belongs to the respective authors, under the terms of the law. Boa Porta does not adopt these contents as its own, does not guarantee its accuracy, completeness or timeliness and does not assume obligations of the participants in the leases. The availability of tools, moderation or a delimited check does not make the operator a person guarantor, opinions or contracts.

To the extent permitted by applicable law, Boa Porta is not liable for falsehoods, omissions or unlawful acts by third parties that are not legally attributable to it, nor for decisions, contracts, payments or losses resulting from the exclusive trust in user content, advertisements or external services. Uninterrupted availability or absolute absence of failures is not guaranteed, although we adopt reasonable security and maintenance measures.

No clause excludes the operator’s own liability where the law does not permit its exclusion, including liability for intentional misconduct or gross negligence, or restricts the mandatory rights of consumers or data subjects. The legal protection applicable to hosting third-party content depends on the statutory requirements and the operator’s actual conduct; these terms do not create that protection automatically.

A user is liable, to the extent of their fault and in the legal terms, for the damages they cause with the violation of their duties. There is no automatic obligation to bear any claim filed against Boa Porta, nor reimbursement of costs without legal basis, imputation and demonstration.

10. Free service, advertising and third parties

The features for landlords and tenants are free. The envisaged financing model is advertising identified as such. An advertisement, external link or reference to a professional does not constitute a warranty, independent recommendation or Boa Porta certification. The third party is responsible for its offer and any contracts it enters into. The provision of new services paid to users would require their own conditions and express acceptance; These Terms do not authorize automatic future charges.

11. RESTRICTIONS, CLOSING AND CHANGES

We may take proportional measures in the face of fraud, security risks, violation of the law or these terms, communicating the reasons and allowing contestation when applicable. The user can deactivate the profile in the personal area and ask for the account to be closed through the indicated contact, subject to proportional confirmation of the identity. Deactivation and erasure are different operations.

We can update the service and these terms. Material changes will be communicated to the holders in reasonable advance, except for legal or security urgency. Retroactive effects are not attributed or the acceptance of new substantial obligations by silence is presumed; new acceptance will be collected when necessary. The applicable version is identified in the acceptance record.

12. Law and conflict resolution

Portuguese law applies, without depriving users of any mandatory protection applicable to them. No exclusive jurisdiction is imposed that would restrict statutory rights. Contact us first to try to resolve the issue; doing so is not a condition for contacting the competent authorities or courts. If a clause is invalid, this does not remove statutory rights or automatically invalidate the remaining separable provisions.
